Terms of Service

Welcome, and thank you for using The BMR App. These terms are the agreement between you and Takao LLC ("we," "us," or "BMR") for your use of The BMR App and the website at thebmrapp.com (together, the "Service"). We have tried to keep this readable. Please take a moment with it, because by using the Service you are agreeing to it.

You need to be at least 13 years old to use the Service. If you are under the age of 18, you may only use the Service with the involvement and permission of a parent or legal guardian. By using BMR, you confirm that you meet these requirements.

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use The BMR App on devices you own or control, for your own personal, non-commercial use. This license is for using the app as intended, and nothing more.

To keep the Service safe and working for everyone, you agree not to:

The people you add to BMR, the rhythms you set, and your history of staying in touch are yours. How we handle information is described in our Privacy Policy, which forms part of these terms. In short: your relationship data is stored on your device, and we collect limited, anonymous analytics to improve the app. You are responsible for the information you choose to put into the app.

The Service may offer paid features or subscriptions. If it does, the following applies:

We are a small team building actively, and the Service will change over time. We may add, modify, or remove features, and we may suspend or discontinue the Service or any part of it. We will try to give reasonable notice of significant changes where we can, but we are not liable to you for changes to or discontinuation of the Service.

The Service, including the app, the BMR name and logo, the design, and all related content we provide, belongs to us and is protected by intellectual property laws. These terms do not give you any ownership of it. You may not use our name, logo, or branding without our written permission.

We work hard to make BMR helpful and reliable, but we provide the Service "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any reminders or notifications will always be delivered. BMR is a tool to help you stay in touch. It is not a substitute for your own judgment about your relationships.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or twenty five US dollars.

You may stop using the Service at any time by deleting the app. We may suspend or end your access to the Service if you breach these terms or use the Service in a way that could cause harm or legal liability. Sections of these terms that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

We may update these terms from time to time. When we do, we will revise the date at the top of this page, and where the changes are significant we will make reasonable efforts to let you know. Your continued use of the Service after changes take effect means you accept the updated terms.

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the courts located in California, unless applicable law requires otherwise.
